In The Originals they basically say that anyone who was born with magic and becomes a vampire loses their magic. But what they don't say is if vampires were to gain any powers once they were vampires and if they could keep their powers. So, in this story any vampire, or werewolf, can get powers from Mako.
When Hayley was a mermaid and the full moon was around, her wolf side doesn't act up because the moon pool is close to Australia and the magic from Mako is suppressing Hayley's wolf and getting moonstruck instead.
Hayley was adopted by the Sertori's when she was 13, when she triggered her curse.
Rebekah, obviously, compelled the Gilbert's, and everyone else in the Golden Coast, to think that she was a Gilbert and her name was Emma.
Because Hope's blood can make hybrids, Hayley doesn't lose her mermaid side when she died because she died with Hope's blood in her own bloodstream.
